The People's Republic of California  -  Don't expect to see teens standing on corners waving signs at motorists encouraging them to participate in a school car wash any time soon in San Jose.

 

While car washes have become a favorite tool for school clubs, teams, cheerleaders and classes to raise funds for trips, uniforms or supplies, the liberal Democrat run city of San Jose is now saying stop.

This is what happened to Lincoln High School cheerleaders  trying to raise money to attend a national competition in April. The San Jose Mercury News reports that local environmental officials warned the high school cheerleaders that their car wash violated the city’s water discharge laws.

“We had a visit from the city of San Jose Environmental Services Department who said that the car washes at Hoover [Middle School] are in violation of water discharge laws, therefore we had to cancel this and all future car washes,” said an email that was sent out to neighborhood email lists on Oct. 18.

“Anything that is not storm water or rain water is considered a pollutant,” said Jennie Loft, acting communications manager for San Jose’s Environmental Services Department.

“If it goes into a storm drain, that pollutant will harm wildlife and habitats in the creeks. Water goes directly from the storm drains into our creeks.”

The city intervened in response to two complaints received about the car wash events Lincoln High Schoolers had been holding at Hoover Middle School. City officials reached out to school and district staff to give them information on how to prevent pollutants from getting into storm drains.

Asked if the city came out in response to complaints, Loft wrote in a follow-up email, "The City of San Jose responded to two complaints, one about a month ago and one last week, re: the Lincoln High School Car wash events held at Hoover Middle School.

"Our staff responds to complaints to ensure that pollutants do not go directly into our storm sewer system since it flows into local creeks, and the SF Bay and Delta.

"As part of our protocol when we received these complaints, our staff reached out to staff at Lincoln High School and San Jose Unified last month to provide information about preventing pollutants into storm drains.

"Our staff also met directly with Lincoln High School Staff last week."

The American Police State  -  A veteran Washington D.C. investigative journalist says the Department of Homeland Security confiscated a stack of her confidential files during a raid of her home in August — leading her to fear that a number of her sources inside the federal government have now been exposed.

In an interview with The Daily Caller, journalist Audrey Hudson revealed that the Department of Homeland Security and Maryland State Police were involved in a predawn raid of her Shady Side, Md. home on Aug. 6. Hudson is a former Washington Times reporter and current freelance reporter.

A search warrant obtained by TheDC indicates that the August raid allowed law enforcement to search for firearms inside her home.

The document notes that her husband, Paul Flanagan, was found guilty in 1986 to resisting arrest in Prince George’s County. The warrant called for police to search the residence they share and seize all weapons and ammunition because he is prohibited under the law from possessing firearms.

But without Hudson’s knowledge, the agents also confiscated a batch of documents that contained information about sources inside the Department of Homeland Security and the Transportation Security Administration, she said.

Outraged over the seizure, Hudson is now speaking out. She said no subpoena for the notes was presented during the raid and argues the confiscation was outside of the search warrant’s parameter.

“They took my notes without my knowledge and without legal authority to do so,” Hudson said this week. “The search warrant they presented said nothing about walking out of here with a single sheet of paper.”

She provided TheDC with a photo showing the stack of file folders in a bag marked “evidence/property.”

On Thursday, a spokesman for the Maryland State Police declined to address any specifics about the search.

At about 4:30 a.m. on Aug. 6, Hudson said officers dressed in full body armor presented a search warrant to enter the home she shares on the bay with her husband. She estimates that at least seven officers took part in the raid.

After the search began, Hudson said she was asked by an investigator with the Coast Guard Investigative Service if she was the same Audrey Hudson who had written a series of critical stories about air marshals for The Washington Times over the last decade. The Coast Guard operates under the Department of Homeland Security.

But it wasn’t until a month later, on Sept. 10, that Hudson was informed by Bosch that five files including her handwritten and typed notes from interviews with numerous confidential sources and other documents had been taken during the raid.

“In particular, the files included notes that were used to expose how the Federal Air Marshal Service had lied to Congress about the number of airline flights there were actually protecting against another terrorist attack,” Hudson wrote in a summary about the raid provided to TheDC.

Recalling the experience during an interview this week, Hudson said: “When they called and told me about it, I just about had a heart attack.”

She said she asked Bosch why they took the files. He responded that they needed to run them by TSA to make sure it was “legitimate” for her to have them.

“‘Legitimate’ for me to have my own notes?” she said incredulously on Wednesday.

Asked how many sources she thinks may have been exposed, Hudson said: “A lot. More than one. There were a lot of names in those files.”

“This guy basically came in here and took my anonymous sources and turned them over — took my whistleblowers — and turned it over to the agency they were blowing the whistle on,” Hudson said. “And these guys still work there.”

The Daily Caller reached Bosch on his cell phone on Thursday. “Before I talk to you, I’m probably going to have to run this by our legal department,” he said.

Carlos Díaz, the chief of media relations for the Coast Guard, said in a statement that the Coast Guard Investigative Service was asked to participate in the raid because the search involved a Coast Guard employee. Flanagan is an ordinance technician for the Coast Guard in Baltimore.

For at least the second time in five months, Arab residents of Beit Umar in the Palestinian Authority (PA) have placed a Nazi flag over a major thoroughfare where Jews pass in their vehicles.

 Beit Umar is located between Halhoul and the Etzion Bloc, not far from Hevron.

Soldiers from the Haruv battalion in Kfir Regiment tried to take down the flag Saturday, but encountered difficulty because it was placed very high up reports Israel National News.

A similar event took place at Beit Umar in May, when hundreds of residents of Gush Etzion who drove down Highway 60 were astounded to see an oversized Nazi flag flying next to a mosque in the Arab town.

The American Police State  -  Pat Vaillancourt went on a trip last week that was intended to showcase some of America’s greatest treasures.

Instead, the Salisbury resident said she and others on her tour bus witnessed an ugly spectacle that made her embarrassed, angry and heartbroken for her country.

Vaillancourt was one of thousands of people who found themselves in a national park as the federal government shutdown went into effect on Oct. 1. For many hours her tour group, which included senior citizen visitors from Japan, Australia, Canada and the United States, were locked in a Yellowstone National Park hotel under armed guard reports the Eagle Tribune.

The tourists were treated harshly by armed park employees, she said, so much so that some of the foreign tourists with limited English skills thought they were under arrest.

When finally allowed to leave, the bus was not allowed to halt at all along the 2.5-hour trip out of the park, not even to stop at private bathrooms that were open along the route.

“We’ve become a country of fear, guns and control,” said Vaillancourt, who grew up in Lawrence. “It was like they brought out the armed forces. Nobody was saying, ‘we’re sorry,’ it was all like — ” as she clenched her fist and banged it against her forearm.

Vaillancourt took part in a nine-day tour of western parks and sites along with about four dozen senior citizen tourists. One of the highlights of the tour was to be Yellowstone, where they arrived just as the shutdown went into effect.

Rangers systematically sent visitors out of the park, though some groups that had hotel reservations — such as Vaillancourt’s — were allowed to stay for two days. Those two days started out on a sour note, she said.

The bus stopped along a road when a large herd of bison passed nearby, and seniors filed out to take photos. Almost immediately, an armed ranger came by and ordered them to get back in, saying they couldn’t “recreate.”

The tour guide, who had paid a $300 fee the day before to bring the group into the park, argued that the seniors weren’t “recreating,” just taking photos.

“She responded and said, ‘Sir, you are recreating,’ and her tone became very aggressive,” Vaillancourt said.

The seniors quickly filed back on board and the bus went to the Old Faithful Inn, the park’s premier lodge located adjacent to the park’s most famous site, Old Faithful geyser. That was as close as they could get to the famous site — barricades were erected around Old Faithful, and the seniors were locked inside the hotel, where armed rangers stayed at the door.

The American Police State  -  Bob Hitchcock is in his “least favorite place” these days — inside his landlocked Las Vegas home instead of at his cabin on the North Shore of Lake Mead, tooling around with old engines in his garage.

He’s one of an estimated 60 families with vacation homes along the lake who were given notice by the National Park Service earlier this week to gather their stuff and leave, according to Christie Vanover, a spokeswoman for the Lake Mead Recreational Area.

The homes — from Stewart’s Point on the north to Katherine’s Landing and Temple Bar on the south — sit on federal land reports the Las Vegas Review Journal.

As a result, the federal government shutdown left Hitchcock just 24 hours to evacuate his two-bedroom, two bath cabin in Stewart’s Point, about 70 miles northeast of Las Vegas.

Although Vanover couldn’t put an exact number on how many residents were actually living in their vacation homes at the time of the government’s closure, she wanted to make one thing clear: “They are all vacation homes and everybody who lives in them are considered visitors,” she said. “If anybody needs to gather their personal belongings, we’re not going to deny them access. They can go do that. They just can’t spend the nights there or have barbecues during the day.

“They need to get in and get out.”

And so the vacation homes will remain vacant until Congress can compromise and end the shutdown, which entered its fifth day on Saturday.

But being an adult about it doesn’t make it any easier being away from what he truly loves: Restoring antique engines inside his garage while making daily trips on his motor scooter to Overton, the closest town, a 15-minute ride to the north.

“I seriously, seriously threatened to stay and not leave,” says Hitchcock, recalling that moment when a pair of park rangers delivered the bad news. “I mean, I thought, ‘Are they really going to come down hard on somebody for trespassing inside his own home?”

In the end, he took his friend’s advice: The last place he wanted to wind up was in federal court.

“I said, ‘What if I don’t leave,” Hitchcock recalled. “And they told me, they’d issue me a citation, and when I asked them what would happen if I didn’t pay the citation, they said they’d take me to jail. And when I asked them which jail I was going to go to, they said ‘Henderson.’ “

Politically speaking, Hitchcock is a lifelong Republican and proud of it. In fact, he sports a shirt that says, “The only thing I hate about Nevada … Harry Reid.”

A Pennsylvania mining company sued by the federal government on behalf of a worker who refused a biometric handscan because he believes in the Bible's mark of the beast prophecy, said on Thursday that it supports religious freedom.

The Federal Equal Opportunity Employment Commission filed a lawsuit against Consul Energy Inc, stating that Beverly Butcher Jr. had worked at the company's coal mine in Mannington, West Virginia, for more than 35 years, until he was required to use a biometric hand scanner to track his hours.

Consul, with headquarters in Western Pennsylvania, was accused of discriminating against Butcher, who repeatedly told mining officials that using the scanner violated his Evangelical Christian beliefs, given his view of the relationship between hand-scanning technology and the mark of the beast in the New Testament's Book of Revelation, the lawsuit said reports Reuters News.

According to the Christian Bible, the mark is implanted on the forehead or right hand and symbolizes allegiance to the antichrist.

Though alternatives to hand scans were found for two employees with missing fingers, the EEOC claims Butcher was forced into early retirement because no provision was made for him.

"The focus is on whether the employer can provide an accommodation without incurring an undue hardship," Philadelphia EEOC regional attorney Debra Lawrence said in a statement.

The company on Thursday declined to comment on the lawsuit but said it did its best to accommodate religious beliefs.

"In appropriate cases we make reasonable accommodations to address any conflict with sincerely held religious beliefs," said company spokeswoman Lynn Seay in a statement.

EEOC District Director Spencer Lewis, Jr. said the company violated Butcher's civil rights when "they obstinately refused to consider easy alternatives to their new hand-scanning time and attendance system to accommodate Mr. Butcher's religious beliefs."

Neither Butcher, whose age was not immediately known, nor EEOC officials were available for further comment.

Authorities in London on Sunday detained and questioned for nine hours the gay partner of Glenn Greenwald, the journalist who has authored a series of recent articles exposing mass surveillance programs by the National Surveillance Agency (NSA).

 

The Guardian, Greenwald’s employer, reports the journalist’s partner, David Miranda, was held for nearly nine hours and questioned under the Terrorism Act at the UK’s Heathrow airport.

Officials also confiscated Miranda’s electronics, including his cell phone, laptop, camera, and memory sticks, according to the UK Guardian, without saying when they would return the items.

According to the report, Miranda was stopped by UK airport officials at 8:30 AM and told he would be detained for questioning under schedule seven of the Terrorism Act of 2000. The law, reportedly allows officers to search and detain individuals at key transportation areas.

 

Miranda was reportedly released without being officially charged with anything.

The 28-year-old was held for nine hours, the maximum the law allows before officers must release or formally arrest the individual. According to official figures, most examinations under schedule 7 – over 97% – last less than an hour, and only one in 2,000 people detained are kept for more than six hours.

Since 5 June, Greenwald has written a series of stories revealing the NSA's electronic surveillance programmes, detailed in thousands of files passed to him by whistleblower Edward Snowden. The Guardian has also published a number of stories about blanket electronic surveillance by Britain's GCHQ, also based on documents from Snowden.


While in Berlin, Miranda had visited Laura Poitras, the US film-maker who has also been working on the Snowden files with Greenwald and the Guardian. The Guardian paid for Miranda's flights.

"This is a profound attack on press freedoms and the news gathering process," Greenwald said. "To detain my partner for a full nine hours while denying him a lawyer, and then seize large amounts of his possessions, is clearly intended to send a message of intimidation to those of us who have been reporting on the NSA and GCHQ. The actions of the UK pose a serious threat to journalists everywhere.

"But the last thing it will do is intimidate or deter us in any way from doing our job as journalists. Quite the contrary: it will only embolden us more to continue to report aggressively."

A spokesperson for the Guardian said: "We were dismayed that the partner of a Guardian journalist who has been writing about the security services was detained for nearly nine hours while passing through Heathrow airport. We are urgently seeking clarification from the British authorities."

Labour MP Tom Watson said he was shocked at the news and called for it to be made clear if any ministers were involved in authorising the detention.

He said: "It's almost impossible, even without full knowledge of the case, to conclude that Glenn Greenwald's partner was a terrorist suspect.

"I think that we need to know if any ministers knew about this decision, and exactly who authorised it."

"The clause in this act is not meant to be used as a catch-all that can be used in this way."

Widney Brown, Amnesty International's senior director of international law and policy, said: "It is utterly improbable that David Michael Miranda, a Brazilian national transiting through London, was detained at random, given the role his partner has played in revealing the truth about the unlawful nature of NSA surveillance.

"David's detention was unlawful and inexcusable. He was detained under a law that violates any principle of fairness and his detention shows how the law can be abused for petty, vindictive reasons.

"There is simply no basis for believing that David Michael Miranda presents any threat whatsoever to the UK government. The only possible intent behind this detention was to harass him and his partner, Guardian journalist Glenn Greenwald, for his role in analysing the data released by Edward Snowden."

A Fascist California State Senator's bill will force gun owners to go to Big Brother Government for a permit before they are allowed to buy ammunition.  In bill after bill Democrats dream up new ways to crack down, limit and restrict the 2nd Amendment rights of the people until that day comes when guns are confiscated.

A controversial gun measure proposed by a Southern California lawmaker that would require background checks for all ammunition purchases statewide is moving forward in Sacramento.

Senator Kevin de León (Socialist Democrat - Los Angeles) first introduced Senate Bill 53 last December, which would require anyone wishing to purchase ammunition in California to first obtain a Ammunition Purchase Permit issued by the Department of Justice, valid for one year from the date of issuance.

To obtain such a permit, the holder would have to pass a traditional background check as well as a mental health check, according to De León. The legislation would also ban online and mail order sales of ammunition to Californians.

In addition, SB 53 would require all ammunition sales to take place at a limited list of State-approved “ammunition vendors”, who would also be required to submit sales records to the CA Department of Justice.

It passed the state Senate 23-15 and is now pending in the Assembly Appropriations Committee.

The Left are out to target and take off the airwaves anyone who effectively presents the case for freedom.  They first targeted the advertisers for Glenn Beck's Fox News program.  Beck's "crime" was daring to vigorously rip the guts out of the Left on live TV.  Fox put dollars ahead of freedom, lost their nerve and dropped Beck.

Now Politico reports that America's No. 2 radio network is dropping Rush Limbaugh and Sean Hannity because of a combination of attacks on advertisers and "public" pressure.

Rush Limbaugh and Cumulus Media, the company that distributes the influential conservative's talk-radio show in some 40 major markets, are headed for divorce, says Dylan Byers at Politico.

Citing "an industry source," Byers says that Cumulus — the No. 2 radio network in the U.S., behind Clear Channel — won't renew either the contract of Limbaugh or fellow conservative talker Sean Hannity at the end of the year. This is "a major shakeup for the radio industry," Byers adds, and it's hard to argue with that. Limbaugh and Hannity have the biggest and second-biggest talk radio shows, respectively, in the country. By a lot.

That also makes Limbaugh and Hannity very expensive, and this reported move by Cumulus to dump the two stars is about money. The two radio talkers are represented by Premiere Networks, a Clear Channel division, and Premiere reportedly wants more money than Cumulus thinks Limbaugh and Hannity are worth. Cumulus declined to comment on the rumors reports Yahoo News.

A year later, the channel — rebranded TheBlazeTV — has 300,000 paying members, brings in millions in revenue, and, in 2012, debuted on the TV sets of 14 million Dish Network customers.

Limbaugh and Cumulus CEO Lew Dickey have been effectively negotiating in public since May, when Limbaugh threatened to leave Cumulus because Dickey had blamed Limbaugh's 2012 on-air insults of Georgetown Law student Sandra Fluke for driving advertisers away and costing Cumulus millions of dollars. Now, Limbaugh critics are calling this apparent breakdown in negotiations a win for the post-Fluke boycott.

"The boycotters did it," agrees Jason Easley at Politicus USA.

They got Cumulus to dump not only Limbaugh, but also Hannity. "Without the public pressure, bad publicity, and shame that the boycott brought on to his advertisers, Rush Limbaugh and Cumulus would probably still have a happy marriage," said Eastly.

If Politico's report is true, "Limbaugh's contentious and seemingly inevitable divorce from Cumulus Media and WABC has moved another step closer to reality," says David Hinckley at the New York Daily News. But that doesn't mean that Cumulus is dumping Limbaugh. "New York radio observers have been expecting for the past year that Limbaugh and probably Hannity would leave WABC, which is owned by Cumulus, for rival WOR," recently purchased by Clear Channel.

That's an important distinction, says Hinckley. And if Limbaugh goes to Clear Channel, it's not like he'll be off the airwaves. His legions of fans would just have to change the presets on their radios.  And Cumulus wouldn't drop conservative talk radio altogether — it would just switch personalities, says Byers.

In recent weeks, "Cumulus has been quietly reaching out to radio talent agents and political insiders about new local and regional station hosts to fill some of the airtime that will be left vacant by Limbaugh and Hannity," he says. "Cumulus is also expected to move some of its existing talent — which includes Mike Huckabee, Mark Levin, and Michael Savage — into one of the slots."

 

"Cumulus has already tried to position Huckabee as a 'safe' alternative (and boring alternative) to Limbaugh," says Adam Martin at New York: "A conservative commentator who wouldn't call people 'sluts' on air." Huckabee doesn't have a huge following, according to Talkers magazine's most recent analysis, but Savage and Levin do.

Readers should take Politico's entire report with a healthy grain of salt, says Radio Ink. "A story like this always seems to pop up around the quarterly earnings call," and it's most likely a negotiating tactic as Cumulus and Premier haggle over a price. For what it's worth, "a source tells Radio Ink nothing has been decided and a deal could even be worked out in the next month or so."

Maybe it will. Maybe it won't. But my guess is that Limbaugh and Hannity have the upper hand. If Premiere asks too high a price from Cumulus, Clear Channel can't really then pay Limbaugh and Hannity less than its subsidiary was demanding. But even if neither Clear Channel nor Cumulus are willing to pay up, Limbaugh has a large fan base that would follow him to satellite radio or the Internet. Glenn Beck seems to be making a tidy sum on his own.
